Hi Nini,

I just ran a report for Is It Keto and found that since June 1st, Is It Keto has driven 95 visitors to Kiss My Keto but has had zero conversions:

For comparison, my conversion rate on Amazon referrals tends to be around 15-20%:

Do you have any idea why my conversion rate is so low on Kiss My Keto? Do you have any additional insight as to where these customers are dropping off?

Thanks,
Michael Lynch

Hi Michael,

Thank you for reaching out!

It does happen. Sometimes, customers are curious and go to the site but leave without purchasing. Other times, they try to purchase an item not qualified for a discount (subscribe & save, bundles or bread).

May I know which do you use to promote: the link or the code? Just so I can give more context on where and when they're best to use.

To assure you that the code is working properly, I did a test order using your code:

Hi Nini,

I use the referral link and display the code for users to enter. Here's an example:

I know it doesn't qualify for the discount, but I still earn commission if users purchase through that link, correct? I'm wondering if Kiss My Keto is failing to count commissions unless they qualify for the discount code.

Thanks,
Michael

Hi Michael,

Unfortunately, all exceptions do not apply to both links and promo codes because they're all discounted already.

It's either the viewers went to the site and left without purchasing or they purchased exempted items. It might have been because the bread is the featured product on the article that they looked for it on the website and purchased it.

I'd like to do something for you though. Can I interest you with 2-3 products? I'll send them over to you so you can create a new article and let's see how it goes.

If this is okay with you, let me know your shipping details and I'll prepare a shipment.

Hi Nini,

I’m confused. The Ambassador documentation states that affiliates earn a 20% commission on all products on Kiss My Keto:

image.png

It sounds like you’re saying that this is not accurate and there are some sales where I don’t receive commission. Can you clarify the exceptions where I don’t receive a commission after a customer completes a purchase through my affiliate link?

For example:

  • If a user clicks my referral link and purchases keto bread, do I receive a commission?
  • If a user clicks my referral link and uses a different promotional code, such as the 4JULY25 code I shared with my subscribers on 4th of July, do I receive a commission?

Thanks,
Michael

Hi Michael,

Yes, you are under the 20% commission rate in Refersion. The code and the link within Refersion accounts are conversion triggers. Whichever is used will trigger conversion, except that the code can give both discount and conversion. But both don't work for bundles, subscriptions, sitewide sale events and more recently, bread. The Refersion platform can show conversions separately which came from codes and which came from links.

For your examples:
1. No, because it's bread.
2. No because it's under a sale event.

We are not able to stack codes and commission links due to the technical limitations of the softwares we are using to run the website. If there is an existing sale or discount, it can only read that one.

The platform can segregate conversions made through links and codes, but it doesn't show information on each visitor except for the #.

I sincerely apologize for the inconvenience and confusion that this has caused. The benefits page you shared is actually being updated and we have temporarily stopped accepting applications via Refersion.

I hope you could allow me to make it up to you by at least providing you with some products.

Hi Alex,

My name is Michael Lynch. I run the site Is It Keto. I joined Kiss My Keto’s ambassador program on June 16th and have begun advertising Kiss My Keto products on my website and mailing list since then.

Nini has been professional and courteous in working with me, but she is currently describing a Kiss My Keto policy that is unacceptable, so I’m reaching out to you to address it.

According to Refersion stats, I’ve driven 120 visitors to Kiss My Keto through my referral links. I was surprised to see that after this many visitors, I had not been credited with any conversions. When I asked Nini about this, she said that Kiss My Keto withholds payments based on exceptions that are not part of the published ambassador agreement.

Specifically, Nini reported to me the following unpublished exceptions:

  • Purchases of bundles, subscriptions, and bread products do not qualify for commission
  • Purchases where the customer applies a sitewide discount do not qualify for commission

These exceptions directly contradict Kiss My Keto’s published ambassador agreement. The Kiss My Keto ambassador page states that the affiliate program pays 20% on sales of all Kiss My Keto products:

https://www.kissmyketo.com/pages/success-page-influencers

This also appears in the Refersion dashboard:

These exceptions also directly contradict messaging from Kiss My Keto.

On July 2nd, Alec Mwali sent out an email encouraging ambassadors to “boost [our] earnings” by sharing Kiss My Keto’s 4th of July discount codes:

image.png

According to Nini, any ambassador who shared these codes or included these banners on their pages received no commission for doing so because Kiss My Keto does not pay ambassadors when customers apply sitewide discounts.

Kiss My Keto is entitled to choose the terms of their ambassador program, but these terms must be clearly published. Publishing one set of commission terms and paying based on a different set of terms is fraudulent behavior.

Kiss My Keto owes Is It Keto the agreed upon 20% of all customer orders to your site that originated from Is It Keto’s referral link. This money is due to Is It Keto regardless of the product the customer purchased or the discount code that they applied, as the published agreement states a commission of 20% with no exceptions.

Please let me know how you plan to address this situation.

Sincerely,
Michael Lynch

Hi Alex,

I have not received a response from you in response to my email dated July 17th, 2020 regarding KissMyKeto’s failure to pay me its advertised commissions.

If I do not receive a response by Friday, August 7th, 2020, I will assume that Kiss My Keto is not willing to honor the ambassador agreement, and I will seek other means to recover the money owed.

Sincerely,
Michael Lynch

Hi Michael,

Nini, our ambassador manager tells me we have already paid you for the most recent conversions. Below are the stats from your affiliate link which seems to be working. See below:

image.png

Now I'm being told you feel you are still owed for older campaigns that weren't tracked properly. To put it blatantly, we are not paying you for your conversions.

Here the thing Michael... We can't pull an arbitrary number out of a hat based on a number of conversions that you feel you were owed.

Nini spoke to Refersion and they told her 0 conversions out of 95 clicks is not impossible so it seems your traffic simply did not convert.

Is it possible your affiliate link wasn't working? Sure, anything is possible but Refersion assures us it's working so I think it's extremely unlikely this was the case.

Do you have any proof of conversions that weren't tracked? If you do please share them here with me and we can address them. We will follow up with those customers to get to the bottom of the matter and of course, we will pay you out accordingly.

Thanks

Hi Michael,

The issue is not with Refersion’s stats but with Kiss My Keto’s policy.

Kiss My Keto’s published Ambassador documentation states that Kiss My Keto pays “20% starting commission on sales of all Kiss My Keto products.”

On July 16th, Nini Perez stated in an email to me that there are exceptions to these terms. Specifically, Nini said that Kiss My Keto withholds commissions on sales of bread products or purchases made during a Kiss My Keto sitewide sale.

Is the information that Nini reported to me accurate? If so, where is that information published? All official documentation I can find says that the payout is 20% on all sales.

Sincerely,
Michael Lynch

Okay, let me follow up with Nini and get back to you on that shortly.

In the meantime, how do you wish to resolve the matter? What outcome are you hoping for?

Thanks

Hi Michael,

I will consider this matter resolved if Kiss My Keto pays Is It Keto full commission based on the published Ambassador agreement.

Between June 16th and July 16th, Refersion’s statistics show that Is It Keto referred 120 visitors to Kiss My Keto and received credit for 0 conversions. I expect Kiss My Keto to pay the full 20% commission on any conversions that were excluded based on Kiss My Keto’s unpublished exceptions.

As a hypothetical example, suppose 10 of Is It Keto’s 120 referrals purchased Kiss My Keto’s bread variety pack for $35.99. Based on Nini’s information, this would not show up in Refersion as a credited conversion because bread is an unpublished exclusion to the Ambassador agreement. Kiss My Keto would still owe the full 20% commission (10 x $35.99 x 20% = $71.98) because these exceptions were never disclosed to Ambassadors.

The above example uses made up figures because I don’t have Kiss My Keto’s purchase records. Kiss My Keto would need to review Is It Keto’s referrals to locate the totals of those purchases. If it’s difficult for Kiss My Keto to review the purchase history in that way, I would accept $88 as a fair estimate of my owed commissions. This number is based on the fact that I’ve earned $26.60 on 36 referrals since July 17th, which is $0.73 per referral. Extrapolating that to 120 visitors yields $88.66.

Sincerely,
Michael Lynch
